01 July 2013 If a deductor deduct tds on salary and not deposits it before due date of return filing than deductee what will do?

01 July 2013 Have you received form 16 from your employer, is it shows tax deducted on salary.

01 July 2013 In such a case if you have received Form 16 from your enployer then you can claim that TDS amount in your income tax return and can as such File your return without waiting for the filing of the TDS return by your employer.
For the assessment year 2013-14 the form 16 has to be generated from the TRACES website and as such it is uploaded only after TDS return is received at NSDL.
You can ask for a manual TDS certificate till the final TDS certificate is issued.

The employers are under a liability to issue TDS certificates before 31st May 2013 and that date has expired now.


01 July 2013 Mr. Ashish barthwal i still not receive form 16 because employer not deposits tds.

01 July 2013 1 Ask your employer to deposit TDS, and file the TDS return.

2 Or Ask your employer to issue Form 16, without depositing TDS amount. In that case only manual Form 16 will be issued.

3 Ask your employer to give affidavit or any thing which states that TDS is deducted.
