21 March 2013 one of my friend is working in a automobile company. Apart from salary he is getting commission of more than 1 lac rs. which is fixed as per different model of the car say on the sale of car "A"- 2000/- per car or say on the sale of car "B" - 3000/- per car. his employer has deducted tds on the entire amount i.e. on salary + commission u/s 192. my question is that on commission tds should be deducted u/s 194 "H" or u/s 192?

21 March 2013 Under Employment agreement, what ever receiving from employer as an employee, need to be treated as Salary nature only. hence TDS u/s.192 only apply. so even commission receiving by employee also salary income only

21 March 2013 Totally agreed with mr. Ramesh as incentives, bonus, commissions are treated as part of salary u/s 192
