Tax on home tuition income and which itr should be filed ?

07 June 2017 My Friend is housewife. She has income from HOME TUITIONS. She received all her income in cash. But she never filed any ITR. Please tell me which ITR She should be filed for Tuition Income? Can she filed ITR 4(S) or not? She also had FDR amount Approx 21 Lakhs. She make all her FDR starting from Year 2005 adding year by year. She also get interest income from FDR in banks amount Approx Rs. 1,75,000/- in FY 2016-17. Please guide, whether she Should Compulsory to FIle ITR or NOT? And also tell me which ITR She should filed? Whether she can filed ITR 4(S) or not?


07 June 2017 She can show her tuition income under section 44AD and file ITR 4S. she should show FDR interest on accrued basis or as per 26AS and claim TDS.

07 June 2017 ITR 4S has been replaced by ITR 4 (Sugam).


07 June 2017 Home tuition Income can't be shown under 44AD.

07 June 2017 Section 44Ad includes all eligible business except agency or commission income. We have been showing tuition income u/s 44AD and it has been accepted.

07 June 2017 Taking home tuition by a single individual will not fall under business. In case of tuition coaching center where salary and rent is paid can only be treated as business.
