08 November 2013 if mohan earn 5 lakhs from a profession in U.K. which c&m is there and after some times he returns from U.K. in India, he receives 3 lakhs in india from his earning. Then how much amt will be taxable in India & U.K.

08 November 2013 Depends on the Residential Status under Income Tax Act 1961.

(1) Resident Indian - Has been in India for 182 days in the previous year - Entire 8 lakhs is taxable subject to relief under DTAA with U.K.

(2) Non-Resident Indian - Has been in India for less than 182 days in the previous year, tax payable only on Indian income.

(3) Resident but Not Ordinarily Resident Indian - various cumulative conditions like more than 182 days in India but less than 365 days in the four years preceeding the previous year, etc. (refer to the I.T.Act, 1961 for further conditions)- tax payable only one Indian income.
