Tax applicability for the services provided

28 June 2021 Sir,
My issue is regarding 2 Cover Open Tender: COVER-1 is Signed Technical Bid comprising Technical aspects of the services offered and "Un-priced Schedule which shows "Rate inclusive of all taxes (to be entered by the bidder)" (Do not quote the rate here). COVER-2 Encrypted BOQ Templated - Price Schedule (must not be modified/replaced, else liable to be rejected for this tender). Basic Rate to be entered by the Bidder in Rs. " Total Amount without Taxes" Kindly Clarify as to whether invoice to be submitted "With Taxes OR without Taxes"? May kindly be clarified.

28 June 2021 These tender documents would be made at some point of time and the same format would be used even after years!!
Since the name of the field is " Total amount without taxes", this would mean the basic value. I think the template should be able to compute applicable taxes once you enter the rate of tax applicable. Just check the total value in the price bid and invoice accordingly.
It is difficult to precisely answer the query without knowing the format of price bid. Usually govt tenders are quoted at basic price and tax and other charges are as extra components.

It may please be informed that as against the submission of 1st Quarterly Invoice, we have received a message as follows:
"Please submit the revised invoice for AMC charges for STP & WTP. As per the Agreement Page no :38 &39 All quoted rates are inclusive of GST and the same were accepted by you. In this regard kindly submit the revised invoice Inclusive of GST Amount.

We regret very much for the inconvenience caused in the matter as ours being a small MSME registered Environmental Service Laboratory being run on shoe-string budget run by two unemployed Graduates from Visakhapatnam District. Your valuable suggestion that helps us to come across a big financial blow since Rate Quoted for was most competitive and unbearable during the course of this Pandamic Situation. May kindly be advised suitably Madam.

If you have accepted rates including GST as per agreement, then you need to bill as per agreement.

We have submitted Singned Technical Price Schedule format wherein indicated Rate inclusive of all taxes and Encrypted BOQ indicating Basic Rate & Total amount without Taxes in Excel Price Schedule. Other than these .No Other Agreement has been executed. Kindly advice.

29 June 2021 If you have quoted tax as extra, then you may invoice for basic value + tax.

Thanks for the reply.
As advised, we have no other go except to submit Revised Invoice inclusive of all taxes. No where in the technical bid, we have mentioned the words ' tax extra'. In case any scope to overcone this issue, may kindly be advised.

29 June 2021 If you have no where mentioned that the taxes are extra, then it might not be easy to invoice taxes as extra. See if you can speak to the client and negotiate the terms owing to the pandemic situation.
