DEAR ALL, MU QUERY IS, IF AN INDIVIDUAL NOT FALLING U/S 44AB APPLIED FOR A TAN AND DEDUCTED TDS AND FILED RETURN. NOW IS IT MANDATORY FOR THAT INDIVIDUAL TO KEEP DEDUCTING TDS AND FILE TDS RETURNS AS HE HAS AN ACTIVE TAN.

If he dont want to do it in future, than its better to go and surrender TAN.. Or else if he doesnt file TDS return, than notice will surely come and may have to pay penalty. Just go and surrender TAN.

If the individual is not liable to deduct TDS, then no requirement to deduct TDS and deposit it just to remain TAN active. TDS will be dedcuted only if there is liabity on the deducter to deduct TDS. As rightly said by Mr. Shivang, if you don't require to Deduct TDS in future, its better to go and Surrender....

There is no requirement to file Nil TDS Return. However, It is better to file a return in order to avoid receiveing notices from NSDL for not filling of return and replying them that since no TDS is deducted, so there is no requirement of filling TDS Return.
