The Annual Performance Report (APR) for a Special Economic Zone (SEZ) unit is filed based on the financial year completed, not on the basis of the completed year from the date of commencement of the SEZ unit. Here’s how it typically works:
### Basis for APR Filing:
1. **Financial Year Basis**: - The APR is filed for each financial year, which runs from 1st April to 31st March. - For example, if a SEZ unit commenced operations on 14th December 2019, the APRs would be filed for the financial years:
2. **Calculation Period**: - The APR covers the activities, exports, investments, and other parameters of the SEZ unit for the entire financial year. - Even though the SEZ unit commenced operations in the middle of a financial year (e.g., December 2019), the APR for that year would cover the period from the date of commencement (14th December 2019) until the end of that financial year (31st March 2020).
3. **Submission Timeline**: - The APR for each financial year typically needs to be submitted within a specified period after the end of that financial year. The exact timeline can vary, but it’s crucial to comply with the deadlines set by the SEZ authorities.
### Conclusion:
Therefore, the SEZ unit should file its APR based on the financial years completed from 1st April to 31st March, irrespective of the date of commencement of operations within that financial year. This approach ensures consistency and compliance with SEZ regulations regarding reporting and performance evaluation.
If there are specific guidelines or amendments related to SEZ APR filing, it’s advisable to refer to the latest notifications or consult with SEZ authorities or a qualified consultant to ensure accurate compliance.
