Service tax on ROC fees

21 March 2009 If client is billed separately for professional fees and ROC fees on MCA e-filing, is service tax chargeable on ROC fees reimbursed by client?

21 March 2009 It woud be ideal to ask the client to pay the ROC fees directly or issue you a cheque in favour of ROC Fees.

If there is an agreement between you and the client to act as pure agent , then you can pay for the ROC fees, provided the ROC fees receipt is in name of the client, then you can raise a separte bill as reimbursemen and no service tax is chargeable on the same.


21 March 2009 Issue a debit note rather for reimbursement of ROC fees in my opinion.

21 March 2009 No need for even saperate billing. You can charge it as reimbursement in the same bill and no service tax is payable on it.
