Service Tax on Rent

07 November 2008 I have a Rental Income of Rs.15 lakhs. From one tenant it is Rs.12 lakhs and from the second tenant it is Rs.3 lakhs. So service tax is to be paid on Rs. 12 lakhs or Rs.15 lakhs. The second tenant is not ready to pay service tax as his rent is only 3 lakhs.Plz explain whether service tax is to be paid on full amount or only on Rs.12 lakhs.

07 November 2008 its your libility to collect service tax & deposit to govt on total income under rent received.

07 November 2008 service tax is to be paid on full amount.If the tenant is not giving service tax then you have pay the service tax deemin that whatever the unwilling tenatnt has paid is inclusive of service tax.


07 November 2008 yes sanjay is absolutely right...It wd be deemed as if service tax is inclusive in 3,00,000...
