Service tax on office premises rent

31 October 2012 We have never paid Service Tax on Office rent till date. The landlord is now asking for the ST amount payment on Rent at 12.36% from April 2012 onwards. Can you please guide on
the following points

1) since we have already paid huge amount of ST to Govt can we offset this amount? and how
2) how do we account the late payments related to ST

31 October 2012 1. you can take credit of ST now paid.

2. there is no late payment. It is late recovery by landlord and timely payment. You can undoubtedly take credit.

So we need to make the payment to Landlord and avail credit for the same amount on future ST payments..........right

You dont have to account for late payment of ST.

Agst invoice of Land lord only you have to pay ST.

There is no delay from your side, he will be in default. Afte payment of ST to landlord you can avail credit..
