Service tax liability

13 July 2012 Dear All,

Can u any one tell me that if someone providing services as Professional on monthly basis and his total services cross the amount of Rs. 20,00,000/- but he is not adding any service tax in his invoice.

so is it company liability (Who invoice received) of non-addition of Service tax?

Pls. do revert asap.

13 July 2012 Not at all. The responsibility lies with the service provider only.

Regarding company liability, if the services provided by the professional falls in the following category, then service recipient is also liable under reverse charge w.e.f 1.7.12 based on % fully or partially. Pl see the relevant notn.

1) advocate/arbitrary tribunal/Govt/local authority bill/ fees.
2) GTA,
3) sponsorship
4) Hiring of motor vehicles
5) Works contract
6) Services provided by non-taxable territory
7) Insurance 8) manpower supply
