21 October 2011 Dear Experts,

I have already submitted Form H along with bill of lading but while carrying out assessment proceedings under Value Added Tax Act, Ld. Assessing authority desired to quote bill of lading number and seal of ship and board.

Sir, is above requirement in assessment, mandatory under the law?

You are requested to kindly guide in above matter by corroborating judgements/circulars/notifications, if any.

There is a problem with the issue of 'H' forms.'H' forms are to be issued to purchase of goods for directly exporting by the exporter.Some expoters are found to have issued to buy goods which are used as raw material in the manufacture of exported articles,which is wrong. In order to verify this point some assessing officers ask for production of copies of bill which shows the actual commoditty that was shipped by the exporter.If it matches with the goods sold by you there will be no problem.If your customer makes any changes to the products sold by you before desptching them out side the country then the 'H' form will become invalid.In such a case you will have to pay tax on such a sale and collect it also from your customer.
