15 October 2011 Dear Experts,
Case-
A(landlord) is saying to his tenant(B) that he have given him room on lease but B is saying that he have taken it on the basis of rent.
Both parties i.e A & b were not having any document in support of..
Query-
So how their settlement can b made????

15 October 2011 I think the tenant is a very old one, because the recent tenancy agreements are made with great care and are mostly on a 11 month lease period basis.

So in this case I don't think any settlement can be made among the parties themselves.
This has to be fought out in the court, or out of the court monetary settlement has to be made. If fought in the court it would stretch very long because none of the parties have proper valid papers to support their claim. So go for out of the court settlement.

16 October 2011 If it is a lease, the tenant must have paid lease amount in advance and no rent.

If it is a rent, the tenant must have paid 10 month (normally) rent advance and paying monthly rent.

Now, what is the dispute???


17 October 2011 No advance have been paid initially,So now how settlement can b made??

So in this case I don't think any settlement can be made among the parties themselves.
