Regarding medical bill 15000 exemption

This query is : Resolved

09 June 2016 I just want to know . i have 15000 rs bill but in which category i need to claim while filing the ITR for FY 2015-16.

I have filled all the information through filing via online mode but confused where i will claim the 15000 exemption. As far as i know section 80D is applicable for medical premium not medical bills .Please correct me if i am wrong.

at another thought was that i have to deduct this 15000 rs from income under head salary but if it is correct then tax details section which is generally filled by default will have wrong calculations ? Please suggest me in this regards

Thanks in advance

10 June 2016 I hope your are talking about Section 17(2) which provides that medical rembuirsement upto Rs15000 is not taxable. You simply need to show your taxable salary in the return form you need not give the break up of that medical prequisite. You can fill the amount from your Form 16 where your taxable salary is given.

10 June 2016 Yes i am talking about section-17(2) but i have shown only 7000 rs bill to my employer not 15000 but now i have 15K bill so i want to claim full amount . However ,my doubt is clear now from your reply . I just need to deduct 15000 from gross income not 7000 thanks

I have one more doubt, regarding section 89 ,Arrears claim tax relief:
My brother is in bank and he has received 92679 amount as part of arrear in FY 2015-16 but it was pending for last 2 year that means FY2013-14 and FY 2014-15.
1. Do i need to equally divide the arrear for each year .equally divide for last 2 year and current year ?
2. after dividing the arrears how would i calculate the tax ,Should i consider the exemptions of previous years like section 80C while calculating tax for last 2 year (with or without arrears as per the instructions ) ?
3. if i am eligble to avail the tax in section 89 then where i need to fill the same inn ITR-1. However i know that i need to fill form 10-E

10 June 2016 Here’s how you can calculate the tax relief yourself –

Step 1 Calculate tax payable on the total income, including additional salary – in the year it is received

Step 2 Calculate tax payable on the total income, excluding additional salary – in the year it is received

Step 3 Calculate difference between Step 1 and Step 2

Step 4 Calculate tax payable on the total income of the year to which the arrears relate, excluding arrears

Step 5 Calculate tax payable on the total income of the year to which the arrears relate, including arrears

Step 6 Calculate difference between Step 4 and Step 5

Step 7 Excess of amount at Step 3 over Step 6 is the tax relief that shall be allowed.

Note that if amount at Step 6 is more than amount at Step 3 no relief shall be allowed.

10 June 2016 ya rachit that i have it.

but my questions are different : while calculating tax on total income should i consider the section 80-C investments ??
Do i need to equally divide the arrears or divide the arrears as per the previous year income structure . like if previous year income was 500000 then arrears should be less as compared to current year as current yr income is 600000/- ?

After calculation if i eligible to claim relief under section-89 where i need to mention it in ITR-1 ? i mean which field of omline ITR form. I read somewhere i just need to submit form 10-E online. but do i need to send the physical copy of form 10-E to income tax deparment ?

10 June 2016 1. Yes while calculating tax for the different years , you will consider all the deductions which are available.
2. Your employer will tell you which year it relates.Surely the arrears calculation must be done by your employer on monthly or yearly basis so take that calculation so that you can relate with the years. Otherwise this is a small amount so you can proportionately divide.
3.There is seperate deduction under section 89 given in ITR form in tax calculations column, you can put that amount there.
4. No. you need not to send any physical form to IT depart.

10 June 2016 Yes thanku so much :-)

Just one more doubt i see form 10-E .. there are multiple tabs were there .. Annexure -I/II/III/IV
Which annexure i should fill ? is it annexure -I

And it seems tax would be computed on total income excluding investment i guess Actually i checked form 10-E just now there is no field for section -80C and all .Just wanted to share with you , May be i am wrong

10 June 2016 Fill only annexure -1.. In salary coulumn fill only salary and in total income coulumn fill after deductions amount. What is the confusion?

10 June 2016 Opps it's my mistake . I was confused about gross income vs total income. I filled every year but still got confused .

thanks now i have all information. :-)
A big thanks to you .

13 June 2016 Hi Rachit,

I have one doubt regarding bifurcation of arrears, suppose total amount is 90000/- and arrears was pending since 2 FY i,.e. 2013-14,2014-15 and including 2015-16(till november 2015 only) then how would do have to divide the arrears .. should i divide 30000 for each FY or divide 90K into two part only.

i am little confused here as little part of arrears is for current year also from April 2015 to Nov 2015. so this amount should not be goes into previous yer amount. Please explain.

13 June 2016 Ask from your employer about the arrear detail. They provide you about which year they relate,

13 June 2016 i have the year details but they just mentioned the lump-sum amount 90000. This is my brother case. He is working in andhra bank.

amount is for FY 2013-14,2014-15 and 2015-16 but till november only. As he has received 90K amount in nov-2015 month of salary. So what i was thinking is to divide this amount by total no of month ..in my bro case, it would be 32 .. and consider arrear as 33744(2812*12) amount for 2013-14 & 2014-15.

an for FY 2015-16 i do not need to put any amount as i we are already doing calculation with or without arrears separately.
Can i do that ??

13 June 2016 Yes you can go ahead with this calculation.
