Income Tax / NSDL Department had issued same pan number to 2 or 3 person due to this I am facing very problem, out of one I have find and is saying department has issued same pan number to me and he is showing all necessary documents for the pan card.
Same pan number issued to 2 or 3 persons due to which my CBIL report is showing negative.
Now I want to surrender this pan number, please advise me proper way for surrendering the pan number to department and issue a fresh pan number in lieu of the same.

Same PAN can not be issued to more than one person. PAN is an unique number different for all assessee. If it has happent you should bring it to the notice of the Income Tax Department along with relevant documents with a copy to CIBIL. There should not be any issue with CIBIL as you have the evidence in form of PAN and your income tax record.
Dont think of surrendering the PAN as so far you must have deposited and filed return with this PAN. I am just thinking if the PAN for 2-3 person were same who got the credit when Tax were being deposited by all three under same PAN?

Tushar ji he has clearly written "Income Tax / NSDL Department had issued same pan number to 2 or 3 person". So how can he be in default? Further, you can surrender PAN when you have more than one PAN. You can't surrender your only PAN.

even if they have issued but still he has mentioned "i am facing problem..so he knows that already it has been issued by mistake and now he must not use it to be on safer side as already its issued to others, so being conservative for any future problems from itd in my view is to talk to juridictional ao only..at last he must decide

Tushar Ji it is my humble request that please do not get angry. We are just discussing/debating on a Topic.
In your earlier reply you have stated that meet your AO and surrender the PAN as you are in default because you are using it.
Now you saying meet and talk to AO which is quite similar to my reply.
I had advised that bring it to the notice of the Income Tax Department with relevant documents and a Copy to CIBIL. As we can not surrender the PAN like this by just writing a letter. Let department suggest you the remedy.
My question still unanswered:
1) How assessee is in default in this case?
2) Can you surrender the only PAN simply by writing a letter?
3) Now my 3rd and very logical question If all three person have same PAN then when any TDS was deducted or any Tax was deposited in whose name the credit was given? I request the author of this query to share the PAN. You can also check the name of PAN holder as per IT Database from link given below:
If it shows your name then fine. If shows any other name then take the printout and attach it to the letter informing the department about this along with copy of your PAN Card bearing same PAN.
Write a letter to PAN Issuing Authority enclosing the evidences, with a copy to your jurisdictional Office and CIBIL.

I had checked online KNOW YOUR PAN and this was showing my name.
This come under my notice when his salary was credited in my 26AS then I had called the company and asked for the same, then they sent me scan copy of pan of this employee with contact number and said that he has same pan number and he has pan allotment letter also.
And same employee had submitted a complaint letter to Income Tax Department saying that some one is using my pan number and sent scan copy of letter copy to me with acknowledgement of Income Tax Department.
And I had asked him whether he has taken any loan which is showing in my CBIL report but he denied. He has checked with Income Tax Department and found that same pan number has been issued to 2 or 3 persons.
I fail to understand what mistake has been taken place by the department in his regard and hence I have no option but to surrender my pan card to the department with a request to issue new pan card in lieu to the above in order to safeguard from any further problems.

It is really shocking if this incidence has taken place.
Advisable to a letter to PAN issuing authority stating all the facts and enclosing the copy of evidence with you. Also give a CC to your Jurisdictional AO and CIBIL.
Department can issue a new PAN card in lieu of the earlier issued one. There is a a proper process for it. Once the anomaly is informed they will guide you appropriately.
