18 April 2012 hi All,

please can anyone consult me over this i have been facing this issue from past few month.

My CA sent me to client for an audit work as told by him for couple of week and then that duration kept on increasing and crossed more then 5 months. He told me that i have to work as an employee for that client and for every leave or work i have to ask him(client) directly.

i opposed that but he blocked by stipend and told me to work as he is finding another person as my replacement, i had a word with the institute but their response was dull as they told me ""convince my CA"".

So my question to you all is :-
1. Can CA outsource his article as full time employee to an other organisation ?
2. What can i do if he refuses to sign me
109 as i ask for termination.

18 April 2012 No, a c.a cannot do like this., better you take termination from him, its very difficult to prove anything and take action.

i spoke to my CA and the institute about the same as well but the response from the institute was quite annoying i still find those words echoing in my ears
"BETA HUM KUCH NAHI KAR SAKTE AAPKE CA SE BAAT KARO AND CONVINCE KARKE TRANSFER LE LO "

the words are simple and clear but my query is that why the fellow will sign my 109 and if he refuses to sign "WHAT CAN I DO"?????


18 April 2012 No other remedy, u try to get it signed from him.

18 April 2012 You approach him with any strong reason, he has to accept, like health, or transfer.
