Labour contractor in 44ad?

24 October 2017 Our assessee (properitor) who is a labour contractor is getting notice from IT Dept for not filling the returns for FY2012-13 & 13-14. the turnover in both year was more than 1 cr. which is also in his 26AS. Can he file the returns under 44AD and show 8% profit and pay the tax and escape any procedural issues...???
