ITR Feed without Form 16

11 July 2011 Dear Sir,

My name is Shailendra Kumar Rai . I am working as Sr. S/w Engineer. My salary is 20000 per month from March 2010 to Jan 2011 but after appraisal I got 27000 to till date.My company promised to me for FORM16 but they are not provide me for 2010-2011 financial year because they did not feed ITR for me .
I want to know that how will I feed the ITR without FORM16.I was very excited for feeding the ITR because Its very Important for each guys.


Please provide me your valuable solution as soon as possible.

11 July 2011 if your employer has deducted tax on source then they have to provide form 16, otherwiase call back the tax deducted and file ITR by paying tax by self.

12 July 2011 Dear Sir

I did not understand that where should call me for paying tax itself ,how much will pay for above salary description. I have 96 thousand room rent receipt(for 1 year) and 30 thousand NSC.

If i am paying tax than what should be say to Income tax Deaprtment about money either it is my salary or getting money to other source because i have no FORM16.Please tell me how to contact to ITR department for this type issues.

12 July 2011 First of all -do not try to touch the hardware when the problem is related with the software.

1. It is better to click first on the employer's folder. Observe the flow chart
therein as under-

1- Whether Salary is received by cheque or in cash.

Outcome 1. By Cash ------> Yes.

Implications & Action: He must not have recorded your salary in his books. But do confirm.
If OK -Forget the employer. and follow the steps-
1. Show your income from business & profession. You can say that you have developed or tried for developing certain programs or you have undertaken tuitions. Show your income that way.
2. Press F1- Go to a CA.

Outcome 2. By Cheque------>

Step 1

Warn/Inform -your employer that you are going to file your return and you will be showing the receipts as professional receipts in case they do not provide you Form 16.

Outcome-1
Non-Deduction of TDS by them attract penalty provisions on them. The employer will certainly help you if he want to continue with you.
Outcome-2
They may not help.
Action- Press F1- Go to a CA. File your income by showing the professional receipts income.

Provide the details of Rent NSC etc to the CA.

12 July 2011 1. First of all; check you have an appointment letter from your employer.

2. If you are paid by cheques; then surely the employer might have deducted tax thereon.

3. If the employer has not deducted tax despite showing the same in his books as salary; he is a defaulter under Income-Tax Act. ( Refer Point No. 9 also ).

4. If the employer does not provide Form No. 16; then have a blank copy of form no. 16 from the internet; provide him the same and get it filled in and signed.

( If employer's software is not working and you are not responsible for that at least ).

5. Ask in writing about issue of Form 16 to the employer. He is bound to issue.

6. Salaried persons earning upto Rs.5 lacs as salary, need not file return of income.
.

7. But still you should have form no. 16; which is your RIGHT.

.

8. Ask other employess whether they have been issued Form No. 16.

.

9. You can see your tax credit by log in at Income-Tax site : http://www.tin-nsdl.com/panregistration.asp and then see your tax credit at "26AS."

11. Recently I have heard that one MBA Institute could not MANAGE to pay salary to its MANAGING DIRECTOR and ultimately he had to leave the organisation.
