Hello sir, Thank you so much in advance for the solution, my Query is that one of my client running tile trading business in Maharashtra. purchase tiles from Gujrat with IGST and sells in maharashtra SGST & CGST. But the problem is that my client in maha. paid FREIGHT charges on receiving goods to third party it means TRANSPORT AGENCIES which is also registered on the portal and filing GST Return. its a brief summary of my query. Now my que. is that Could i claim ITC on Freight or not...?

Ok but how could i ?, if that transport agency does not uploaded freight bill in his GSTR-1. i have alomst 6 lakhs Rs. freights bill since april-19 to till date some of Transport Agencies are not registered. but as per you said 12% i can claim on freight plz tell me brief. And thank you so much for your valuable answer. so plz tell me how could i claim in 3b

Check the freight bill any GST claimed in the bill. If no GST claimed in the freight bill and materials transported by GTA then you are liable for 5% GST payment under RCM. After such payment you can claim ITC.

Yes, you can claim the ITC charged in the freight bill. In the invoice issued by the transporter check for the GST component: a if the same is not mentioned, then you have to pay under RCM & then claim ITC b if the GST component is mentioned then you can claim the ITC
