Is input tax credit admissible on depb/fms licences

Please clarify on the above subject. In case the ITC Vat is admissible, is there any notification for this.

Since DEPB licenses are categorised as goods. This is very basis for a dealer to claim input tax credit on the same as a dealer of DEPB license.

Is there some notification which clarifies this. Our assessing officer in Ghaziabad, Uttar Pradesh has refused ITC on DEPB licences.
Please assist us.
