19 August 2013 sir if interstate sale is made then credit of excise receivable to purchaser or not?

19 August 2013 CST and excise are different TAX so excise credit is receivable to purchaser regard less of interstate purchase or local purchase

19 August 2013 Yes, if inputs are used TO manufacture of those units WHICH ARE USED IN inter state sale


19 August 2013 if the final product is exciseable, then exicse paid on input is allowed

20 August 2013 i understand the above matter,if purchaser issue form c then also eligible for credit or not ?

20 August 2013 Form C is relevant for Interstate sale to reduce CST rate 4% instead of 12% in case of sale without C form.

Its not relevant for the purpose of claiming Cenvat Credit of Excise Duty paid on Input (purchase)

21 August 2013 you have to take in mind that CST ACT and Excise is different act and input excise can be claimed whether the purchase is against form c or not
