HRA exemption claim

13 November 2008 Dear sir
if a private sector employee living in rented house and paying rent Rs5000 pm to govt employee, then how can tenant claim for hra exemption as govt employee hav'nt given any receipt and even wants to give any declaration or affidavit stating that he has been receing so much of rent from tenant.
As i m accountant and i have to calculate tax of that employee ie.tenant

13 November 2008 1st of all tell that person to give any reciept even if it is manually.

Then apply section 10(13A) rules of HRA

13 November 2008 but sir if he is giving manually receipt then in that case also he has to mention the PAN NO, of his land lord,and the land lord is otherwise govt employee.
and also tell me that is any objection to incometax dept and to govt also if an govt employee generating income from any other sources like rent in the above case...if yes then y??


13 November 2008 It is enough if he gives a declaration that he has received so much of rent from you. Ensure that the rent is paid by a/c payee cheque, to make your case stronger. There is no problem for the govt employee to earn rental income on his House property.

17 November 2008 Create Rent agreement and make them it as a proof.
