08 November 2013 I am paying house rent above 10000 per month (with rent agreement). As per new circular, tenant has to submit PAN of owner incase annual payment exceeds Rs 1 Lacs. I want to know incase owner is not willing to provide the PAN, whether I can claim HRA exemption based on actual paid amount as per agreement?

08 November 2013 You can claim till the Rent Rs.1 lakh if house owner not provide the PAN.

But, house owner liable to provide the PAN as per income tax rules since he is getting rental income of more than Rs.1 lakh per annum. insist him to provide, otherwise you will pay tax on his income

08 November 2013 i) PAN is required.

ii) In case the landlord does not have a PAN , a declaration to this effect from the landlord should be filed by the employee.

If either of the two is not given to the employer, in all probability, your claim for HRA will not be considered by the employer for the purpose of TDS.
