Income tax Act,1961 didn't have an express prohibition to do so. But as per Indian custom, a commercial advantage can't be taken out of marital status. Therefore, if you do so , I see a probability of litigation with tax department.

Hi As per your query if you are staying in a rented house in the same city, in which you have your owned house for some genuine reasons such as distance from your working place then you can very well claim HRA. yes you can show paying rent to your husband but you need to keep a record of rent receipts. however if the house owned by you is left vacant then also you need to show notional income under the head income from house property
