08 March 2014 I am salaried employee. i have flat in panvel but i am staying with my husband at Kurla. shall i show in my tax return, i am paying rent to my husband and claim for HRA allowance.

08 March 2014 Income tax Act,1961 didn't have an express prohibition to do so. But as per Indian custom, a commercial advantage can't be taken out of marital status. Therefore, if you do so , I see a probability of litigation with tax department.

As per your query if you are staying in a rented house in the same city, in which you have your owned house for some genuine reasons such as distance from your working place then you can very well claim HRA.
yes you can show paying rent to your husband but you need to keep a record of rent receipts.
however if the house owned by you is left vacant then also you need to show notional income under the head income from house property


08 March 2014 you may claim so. but your husband shall have to pay tax on such rental income
