We are purchasing materials by paying gst taxes and claim gst input tax credit.how will we know whether the seller is depositing gst taxes to government.We are paying our gst taxes to sellers and if sellers dont deposit gst taxes what will be our liability.please clarify?

There are a few things you need to check 1st go to search tax payers on gst.gov.in and there you can find out if the dealer has filed returns, then you can refer to GSTR2A to find out if it is reflecting if not then contact the seller and check the details of your GST number with him. If he has not paid or filed the return the department has the right to recover it from the purchaser even though the tax has been paid by the purchaser to the seller

The seller have shown in returns as we can see in 2A but still seller have not paid his taxes so will i be liable if the seller does not pay taxes.

I received notice from gst department that seller had no proper input tax and so I need to pay taxes to government as my input tax credit is cancelled.

You reply to the notice seller has filed return see 2A it is reflecting collect the tax from seller as I have paid the tax to seller.

As per the provisions of GST act the purchaser is liable to pay gst if the seller does not pay. There is no recourse to the same. However the gst council has slightly changed the provisions. But at the end it’s the purchaser is liable.
