GST has been suspended

This query is : Resolved

10 July 2024 Our GST registration has been suspended due to non-filing for six months, and a show cause notice was issued one month ago. Consequently, I am unable to file an application for the revocation of the cancelled registration on the portal. What should I do? Can I file the remaining due filings without revocation?

22 July 2024 IN MY OPINION, APPROACH AS SOON AS POSSIBLE YOUR RANGE AND EXPLAIN THE DETAILS TO INSPECTOR AND SUPERINTENDENT.

26 July 2024 If your GST registration has been suspended due to non-filing for six months and you have received a show cause notice, here's how you should proceed:

### **1. **Addressing the Suspension and Show Cause Notice**

#### **A. **Respond to the Show Cause Notice**
- **Review the Notice**: Carefully read the show cause notice to understand the issues and the specific reasons for suspension.
- **Prepare a Response**: Draft a detailed response addressing the reasons mentioned in the notice. Include explanations for non-filing, reasons for delay, and any supporting documents.
- **Submit the Response**: Submit your response to the GST department within the stipulated time. You can do this through the GST portal, or if it’s not possible due to suspension, you may need to submit it physically at the jurisdictional GST office.

#### **B. **File Outstanding Returns**
- **Filing Delays**: Even if your registration is suspended, you should try to file the outstanding returns (GSTR-1, GSTR-3B, etc.) for the periods in question. This may be necessary to clear up your account and rectify the status.
- **Late Fees and Penalties**: Be prepared to pay any late fees or penalties associated with the late filing of returns.

### **2. **Application for Revocation of Cancellation**

#### **A. **Check Revocation Eligibility**
- **Status Check**: Log in to the GST portal and check if you can still file an application for revocation. If the portal does not allow you to file due to suspension, you need to resolve this issue with the GST department.

#### **B. **Contact the GST Department**
- **Visit GST Office**: Visit your local GST office to inquire about the procedure for revoking the suspension and submitting the revocation application.
- **Submit Documentation**: Provide necessary documents and a written request to the GST officer to reinstate your registration and proceed with the revocation application.

### **3. **Filing Returns Post-Revocation**

#### **A. **After Revocation**
- **File Outstanding Returns**: Once your GST registration is reinstated, file all pending returns. Ensure you address all periods for which returns were missed.
- **Update Records**: Ensure that all records are updated, including invoices and tax payments.

#### **B. **Reinstatement Implications**
- **Compliance**: Ensure full compliance with GST regulations to prevent future issues.
- **Regular Filing**: Regularly file returns and maintain accurate records to avoid further suspensions or cancellations.

### **4. **Additional Considerations**

#### **A. **Interest and Penalties**
- **Understand Liabilities**: Be aware of any interest or penalties for delayed filings and ensure they are paid promptly to avoid further complications.

#### **B. **Professional Advice**
- **Consult a GST Professional**: Given the complexities involved, consider consulting a GST consultant or tax professional for guidance on the revocation process, filing returns, and resolving the suspension.

### **Summary**

1. **Respond to the Show Cause Notice**: Address the reasons for suspension and provide explanations.
2. **File Outstanding Returns**: Try to file all overdue returns if possible.
3. **Contact GST Department**: Visit the GST office to resolve issues with revocation and filing.
4. **Post-Reinstatement**: Once registration is reinstated, ensure all returns are filed and compliance is maintained.

By following these steps, you should be able to address the suspension, apply for revocation, and ensure that your GST registration and compliance are up to date.
