27 May 2010 Whether form 15CA and Form 15CB (payment to non residents) is required to be submitted to Assessing Officer after the same has been submitted to Banks?
If yes, then what is the time limit for the same and to whom it should be submitted whether Income Tax assessing officer or TDS Assessing Officer.


27 May 2010 FORM 15CA IS NOT REQUIRED TO BE SUBMITTED TO ITO OR TDS AO.

27 May 2010 But as per the flow chart issued by the Department on procedure to payment of non resident dated 1/7/2009 it states in the last line that the same is required to be forwarded to AO.

27 May 2010 The form is required to be submitted to the A. O. which as per my knowledge is forwarded by the bank itself.

27 May 2010 BUT AS PER MY PRACTICAL EXPERIENCE 15CA IS DIRECTLY ACCEPTED BY BANK AND ONE COPY IS KEPT IN RECORD AND PRESENTED TO AO WHEN QUERY RAISED DURING ASSESSMENT. HAVE NOT SEEN ANYBODY FORWARDING 15CA TO AO.

27 May 2010 That is what i am saying. We do not forward the form to the department but the bank does the same. The same is there is the flowchart as mentioned above which could very well be only on a query being raised by the department.
