Dear members Please clear me some point regarding Excise duty benefits..
" we have two plant one is non exciseble second one is exciseble, we purchase some raw material in non exciseble plant with excise duty on supplier invoice, now we are going transfer material to exciseble plant can we take benefit of excise duty in exciseble plant. if yes please clear me about this and send me notification of govt.

under same identity when one unit is paying duty, another unit can not be exempted.
refer the notification 8/2003
(vii)
the aggregate value of clearances of all excisable goods for home consumption by a manufacturer from one or more factories, or from a factory by one or more manufacturers, does not exceed rupees three hundred lakhs in the preceding financial year.

Dear u.s. sharma.... first of all i want to thanks to reply my query .
you told me that. under same identity when one unit is paying duty, another unit can not be exempted.
my plant is in uttarakhand so its true that one plant is exempted by excise and another is non exempted .. our first plant is old plant (non exciseble) second is new plant (exciseble). by the central gov. notification if any body starting the plant before march 2010 than he will exempted from excise for 10 years if he will installing plant after march 2010 than he will not exempted. so our second plant start after march 2010 so it is not exempted

your one plant is availing area based exemption, and its not catagorized as " non excisable"
exempted unit can not do any activity for paying or transfer of excise duty ( except the dealer registration activity), and once its found that the unit has done any such activity, the exemption would be deemed as lapsed.
