Excise on imported goods

06 April 2013 Dear Sir,

I am importing Heavy Metal Scraps (HMS 1) from South Africa and as per mentioned in Central board of Excise & custom basic duty is NIL on this but Excise duty is 12.36% on it. My role is as a trader only as i have to sell goods to my buyers
Please tell me who will pay excise duty ? and if i pay what are the condition of refunds ?

07 April 2013 Pls Clarify: Who r ur customers, traders or manufacturers? When u say Excise Duty, u mean to say u r paying CVD on import?

08 April 2013 Dear Mr. Ashish, my customers are end manufactures.

My Questions are

1. If i pay CVD 12.36% then can i get it back from manufactures ?
2. Can i claim for 4% SAD from custom department ?


08 April 2013 Dear Mr Rathi,

1. CVD can be availed and its credit can be passed on to your manufacturers who can further utilise it for payment of their Excise duty.

2. SAD is levied in lieu of VAT and can be passed on or adjusted on VAT you are liable to pay on sale of your goods.

Ultimately, they wont be your cost.
