23 May 2011 My query is regarding artile 5 in DTAA's...for Service P.E.

If an employee is on dual employment with home and host countries both, Is this will create a Service P.E. or not.

Please refer any case law or article or notification etc... in supporting to your answer...

23 May 2011 The issue can be decided based on the control and reporting of the employee. Also the salary payment by the home or host country shall also help in deciding the issue.
