RAISED A BILL FOR COMMISSION OF RS.5.00 LACS ON 31.03.2009. PAYMENT WAS RECEIVED IN APRIL 2009 AFTER DEDUCTION OF TAX. SINCE TDS CERTIFICATE WAS NOT RECEIVED,AND THRU OVERSIGHT THIS INCOME WAS NOT INCLUDED IN CALCULATION OF INCOME FOR 2008-09. WHAT IS THE REMEDY.KINDLY ADVISE

Dear Mr. Aditya Thanks for advise. Problem is that TDS certificate has not been received by us. If TDS certificate relates to 2008-09, can we claim TDS in current year.

First ask for the TDS certificate from the client.
then as income in respect of the TDS certificate is being shown in the current year so TDS can also be claimed. Always TDS claim should be accompanied by income.
Also since TDS has not been shown in the last years return as well as income is also not shown you can show both in current years income.
If last year income had been shown and TDS had not been claimed then TDS could have been claimed in the last year by way of filing revised return
