Cn frnd abroad pass on foreign donation 2 Indian SB Ac

16 February 2021 Respected Experts,
My sister is suffering from CKD(Chronic kidney disease)..Its a very critical illness where both kidneys stop functioning & one needs dialysis to breathe.The second option is kidney transplant. Plus there are other complications of the teeth etc..All this is way too expensive for middle-class people like us..There is an organisation in the US willing to help us ..They start an online petition and pass on whatever money online donors give for our cause..But this money is like donation..But from foreign land..How can I receive it in India? Are there any provisions.. For eg: Can my friend(who's staying abroad ) take it in his account and then pass it on to me ? Will it be considered?

17 February 2021 Friend taking the money is not advisable tax payable.
Approach a charitable trust registered user FCRA to receive the money from US organisation and give it to you that is allowed.

Sir , u mentioned in ur reply that tax is payable..But by whom? By me Sir? And in what category will such income fall? As in will it be income from other sources?
And one more query...Someone told me that u can receive upto Rs.50,000 (in one financial year) from a friend as "Gift" ..It's not taxable in my hands..So shall I limit my transaction (if my friend manages to raise funds) upto Rs.50,000 then Sir? 17 February 2021 Whatever some one told is right up to 50,000 gift not taxable. Tax payable by you for exceeding this amount.

Can I just ask u one last query pertaining to the same ..Gift from friend has a limit of 50,000 to be considered as a tax free gift..But if a relative gives us any money, that doesn't have any such limit na Sir?
For eg: I have a brother abroad(distantly related from my mother's side) . Can he pass on the same money ? Will that still be considered as "Gift" and won't be taxed in my hands ? And is there any max/upper limit for such gift from a relative Sir? And what documents does the tax Dept need (in case they ask) to prove a relation?

18 February 2021 Only blood relation gift allowed without any limit. Gift from distant relatives not allowed.
Ask your brother abroad (distant relative) to gift the amount to his blood relative in India. Get the amount from the relative.
