10 September 2012 dear all,

I am working on full time basis, but from last year I have been on official tour's for most part of the year (i.e. for more than 182 days).Though I am getting salary in india I get DA for the time I stay abroad.

Now my query is how will i file the return for AY 13-14.
under what status?
also till last year i have claimed PPF(u/s 80C)
but one of my friends tols me that a NOn resident cant have PPF benefit.
where should i save this year to reduce my tax laiblity and is there any other legal compliance that i have to follow or i can continue filing returns as i used to do till last year.

thanks in advance!

10 September 2012 As per Income tax act,1961 any person who was present in india in previous year for more than60 days and 360day in the period of four years block ended on immediately preceding the previous year than he will be considered as resident and any Salary part of that which arises and due in india is taxable in india.so in the given case you will be treated as resident and allowed for ppf investment .

10 September 2012 sir, in my case i was not in india for only 50 days in FY 11-12 i.e AY 12-13.
so it makes me Non resident for FY 12-13.

since act reads any person who was in india for not more than 182 days in india shall be NR.

the clause that you have referred is to assess ROR or RNOR.
isntit

pls chek and reply again.
thanks!
