what r the solution or next procedure that asseesse has to follow?
what r the forms are require to fill?
what r the fees ?


07 January 2012 file appeal with CIT(A) in form no. 35

Fee at the following rate is payable for filing the appeal before Commissioner (Appeals) :
Assessed total income
Rs.1 lakh or less Rs.250/-
Assessed total income more than
Rs.1 lakh but not more than 2 lakh Rs.500/-
Appeals involving total assessed income
More than Rs.2 lakhs Rs.1000/-
Appeals involving any other matter Rs.250/-
There is a prescribed from for filing the appeal (Form No.35). The form should be signed by the assessee. The grounds of appeal and the statement of facts are also required to be filed along with Memorandum of appeal.
Appeal must be filed within thirty days from the date of receipt of the relevant order.

Better to hire a consultant and let him do the procedure

07 January 2012 Next procedure is file an appeal before the Commissioner of Income tax (appeals).Related section and rules are section 246A and rule 45 of the Income tax Act,1961 and the Income tax Rules,1962. Appeal should be filed in Form no.35. Appeal fee depends on the amount of income assessed varies from 250/- to 1,000/-
