GTA Services-urgent

Dear Sir,
My company is receiving services from the individual transporters who is not registered with any department and not issue any consignment note for the services rendered to us. In that case we have not depsoit any service tax on that transportation and not filled service tax return from the sate of registration year 2004-05.

Now the department issue a notice to us that you are registered with the department and not filled any return hence please provide the information from the 2004-05 to 2008-09 in given format:
S. NO. Month/year Amount Paid Tds deducted Remarks

Now i want a opinion of experts that what I will do for save any penalty?

Is i am liable to pay the service tax on such individual transporter they are running there vehicle only for their livelihoof? and file the returns or file the Nil returns ?
how to I save from the penalty?
Pls guide me properly so I can do better?

We are the registered manfacturing company?

Applicability of Service Tax

I would like to know the SERVICE TAX APPLICABILITY on the following transaction.

A Bank enters into an agreement with a company for opening of ATM's. Wherby the company shall be responsible for construction of ATM's at the designated site and operate the ATM on behalf of the bank. Bank charges a lump sum amount as "LICENSE FEE" payable by the company on entering into the agreement. My question is the service tax applicablity on the lump sum LICENSE FEE paid. If so under which service??

Foreign remittance

My Company is having software business incurring some expendiure on advertisment in respect of business promotion and other party Charged service tax on the same. I make the payment for the same. The foreign Company after some time remitt some expenditure in foreign currency to me not to other party in respect of such expenditure. I have the folloing query on the above case:
1. Should I charged the sevice tax on the foreign remittance to foreign country
2. Is any other way to secure from Service tax applicable

Input Credit

Can it be possible to utilise certain percentage of input credit available for the month say 70:30,or it needs to be looked itemwise for availing input credit

Sir,

Mine is a STPI registered 100% EOU and we are into Media Transcription which involves downloading the test files and process it and upload and requires good english skills.


Though we are registered under AP VAT ACT, we have not claimed any refund for all my input taxes.

My question is are we eligible to claim refund of input taxes paid on Capital Goods and Rev Expenses.We started the Company in 2005.As out exports are 0% rated, we are not paying any taxes.

I request the experts to reply.
