Rule 6(3)computation

query to be asked-regarding Cenvat credit rule 6(3)

in case of a person providing exempted as well as taxable services he has three option to take the credit on input services
1. maintain the seprate account and take the cenvat credit on input services utilized for providing taxable output services.
or
2.Pay 8% amount of exempted services and avail whole cenvat credit on input.
or
3.pay proportionaste amount

now the question is to calculate the 8% or proportionate amount, the value of exempted services we will have to take the value of previous year.

the second question is in the current year there is no exempted services provided still in such case we will have to pay the 8% or propotioanate amount based on the previious year value to take the cenvat credit.

to take the cenvat credit on input there must be proper invoice but in case of rent if there is an agreement between the party still is it necessary to issue the invoive to the party

What is CT 1 Bond & how it is used ?
I got an order from Foreign customer. I had given the manufacturing of material to our different vendors. Now vendors are asking to complete the formalities. Pl. tell how to act. The incoterm in Customer PO is FOB INDIA

I have paid the education cess payable for the month of December 2008 by debiting it through the cenvat credit basic excise duty? Can we utilise the credit of Basic Exicse Duty for the payment of Education Cess as the cenvat credit of Education Cess was not sufficient for the payment of education Cess? Please inform me as early as possible.

Dear Experts,
Most of the intermediates for our production purpose is being done by processors/job workers and the raw materials used are Non-excisable minerals/earth minerals
Now the case is while importing such materials we are not paying any excise as they are non-excisable commodity-
The process loss/wastage is around 58% at the end of the processor- in this case is it required to pay excise duty of the generated waste, the waste is neither returnable nor sell able.

CENVAT Wrongly taken in 23C instead of 23A

Dear Sir,

Good Morning. I had taken CENVAT credit in RG 23C instead of RG 23A. and file the Excise return accordingly. Can I reverse the same and take the correct claim in this month's return? Plz. explain.

We are a MNC auto-ancillary unit. Our plant is scheduled to commence operation by 2010. In the meantime, we are importing material and passing to a Job-worker who does the conversion using imported/indigenous matl. He hands over finished goods to us for sale to our customer in India.

Query : We want to import material in our name and pass on to job-worker, so that he can avail CENVAT benefit and pass the same to us.
Pls let us know how to enable the job-worker to avail CENVAT ?
We only have a Regd. office. in India and cannot inward the import material into our premises. The imported material has to go to the job-worker premises directly. The title of the goods should be with us. (Earlier practice of endorsement of B/E has been dispensed with now).

Mandatory to maintaine excise record

Sir, I wants to know minimum excise records which are to be maintained for who is paying excise duty 1 core (CENVAT + PLA). RG 23 A Part I and II is required to maintained? Is it mandatory. If possible pl give a reply with ref. means notification no., circular, it will helpful to convince to local authority.
