We are planning to change the auditor from financial year 10-11.Our old auditor is fine with the same but yet not given the resignation letter. the date of signing accounts by the auditor for FY 09-10 is 1st September 2010 and date of AGM is 24th September 2010. Can his resignation letter be dated 25th September 2010?If no then in which period the date should fall?
We have till now not finalised the name of the new auditor. if we only mention in the notice of AGM and Director's report that the old auditor is resigning will it be fine?
Or is it necessary to give the name of new auditor

Actually your auditor is not resigning and this is not a resignation case. So formal resignation letter is not required.
You are simply appointing firm B in place of firm A. So fully comply with section 225.
If you still want to collect letter from previous auditor then letter's date should be Sept 24, 2010 i.e. the date of AGM bcoz on 24 sept he is still your auditor.
