21 August 2011 Hi,

I had started my articleship on 12/12/2007. I am a PCC student so my articleship ends on 11/06/2011 (3 & 1/2 years).
I've taken total 400 leaves in my total articleship period & my principal had deducted stipend for each and every leave i took, he has paid me stipend at the minimum rate as prescribed by ICAI.
I have my queries as follows:

1) How many excess leaves have i taken i.e. how many days my articleship will be extended?

2) Am i entitled to receive stipend for 180 days of leaves allowed by ICAI? If yes at what rate?

3) If my articleship is extended, I am entitled to stipend at what rate?

4) My principle has also marked absent for the intervening holidays between the exams, i.e. say for PCC exams if the total exam days are 11 days, then i've been marked present only for 6 days & a sunday(total 7 days). My Question is are all the 11 days to be marked present?

5) It is August'11 & I am still working with the same principle & doing my CA finals now, we have not yet filled any form for extension or termination or articleship. What do i Do?

I suggest to get the articleship training book from the institute or you may get the same from your employer too.

Reading that may help you in getting more about the articleship rules and regulations of our institute.

Let me try to work out on your query :

1. Total days = 1278 Days
2. Leave taken = 400 Days
3. Leave entitlement = 146 Days
4. Period of extension = 254 Days

In your extension period, you will get the stipend at current prevailing rate.

Suggest to immediately file the relevant for for extension to avoid any consequences.
