A non resident in india can file return in india?

02 January 2016 Respected sir/mem, A person who I is in dubai for more than two years.. he earns salary there and deposited in his dubai's bank a.c.? he is an Indian origin, and he has India pan card also.. so whether he can file return in India? whether his annual income of Rs.12,00,000 is taxable in India? or is he liable for any other tax? please do the needful thank you...

03 January 2016 He is an NRI. If he does not have taxable income in India, he is not required to file the return.

but he want to file return bcz he will shift in India with in 7 to 10 months,
so whether his income of salary of 1200000 in dubai deposite there in dubai's bank account is taxable in India?
or entire income is exempt?
which itr is to be filed and which section is to select?

04 January 2016 There will be no tax on Rs. 1200000/- i.e. Salary deposited in the Bank A/c in Dubai. While returning he may remit the amount in his NRE a/c or other Bank A/c in India.

If he wants to come back in India during the middle of FY 2016-07 then he should plan in such a way that he remains NRI for FY 2016-17 too.. He should plan to return after 03.10.2016.

04 January 2016 sir when i use itr 1 for filing return and show 1200000 salary income in itr select residental satus as "non resident" and calculate tax though it shows tax more than 200000 plus..
sir his foreign income is exepmt in India as per it rules as he is non resident, than what should I do?
and under which section should I choose for..?
