80C deduction for Stamp duty and registration

02 February 2011 I have purchased flat,already 90% amount paid to builder, 72,000/- paid towards stamp duty and registration, can I claim 80C deduction in AY 2010-2011 ? Is any proof is required ? what proof ? if bulider is ready to give possession letter on 90% of amount paid,is this would be sufficient proof ?

02 February 2011 I think you are talking about Assessement Year 2011-12( i.e Financial Year 2010-2011), because deduction is allowed only on payment basis .Mostly deduction under 80C is allowed on repayment on loan taken for purchase of house property . But to confirm from my side I went to the INCOME TAX WEBSITE and got the foll. info related to Sec 80C :-
(xviii) for the purposes of purchase or construction of a residential house property the income from which is chargeable to tax under the head “Income from house property” (or which would, if it had not been used for the assessee’s own residence, have been chargeable to tax under that head), where such payments are made towards or by way of—
(d) stamp duty, registration fee and other expenses for the purpose of transfer of such house property to the assessee .

So in my opinion u can get the dedcn if uhave paid it in th F.Y 2010-11 .And maximum limit is Rs.100000/- . So it is immaterial whether 90% amount is paid or not .
No PROOF is required .
