notices issued by it offficers

02 January 2014 Good evening my dear experts.......
i have some doubts,when will be notice u/s 143(1),(2),(3) issued by it officers.

what is the difference between them. plz explain the above

02 January 2014 1. Intimation is issued u/s 143(1). This is issued when the income tax return filed by the assessee is processed by the department. If there is a demand in the intimation then it is treated as a notice of demand u/s 156.

Intimation is issued for each and every return.

2. Notice u/s 143(2) is issued to make a scrutiny/regular assessment u/s 143(3). It implies that assessment proceedings have been initiated in the case of the assessee. The assessee is required to furnish details & documents asked therein.

3. 143(3) is assessment order which is passed on completion of assessment proceedings.

1)if there is a refund in 143(1) then, what it will be called.
2)what is meant by assessment compleated,and when it will be compleated.

02 January 2014 1. Intimation u/s 143(1) is always known as "Intimation u/s 143(1)"

If there is a refund, then the refund will be issued to the assessee.

If there is a demand it deemed to be a notice of demand u/s 156.

2. Assessment means determination of total income and tax payable. This is done by the assessing officer (an officer of the income tax department).

An assessment is said to be complete when the assessment order is passed by the assessing officer.
