09 February 2011 Dear Sir,

If the self asst. tax has not been paid in full before the date of filing of return, can the balance amount payable be paid at a later date.

Kindly reply.

09 February 2011 Yes. You can file the return showing Tax Payable and pay the amount at later date. But it is advisable to pay the due taxes before filing of the return as the details of payment will reflect in your return.

09 February 2011 But your return will be treated as defective.

09 February 2011 I know a case where a person filed electronic return showing tax payable and now he has received intimation u/s 143(1) demanding tax payable along with interest.

09 February 2011 I also filed a return showing tax payable and paid the tax later and the return was accepted. But is always advisable to pay SAT before filing of return.

09 February 2011 It is true that return can be filed without paying SAT but as per provisions of sec. 139(8), it is defective one. In the on-line system, returns are being accepted but in case of scrutiny, it may be treated as defective. There are many lacuna in the on-line system and therefore, benefit may be taken. Morever, all the defects u/s 139(8) are curable.
