one of my friends father receive family pension in c. y. related to earlier 4 yrs. so he came in to 30% slab rate in the c. y. can he get sec. 89 relief or any other relief?? please guide

Agree with the expert, the “relief when salary, etc., is paid in arrears or in advance”, comes under chapter VIII (Rebates and Reliefs) of the income-tax Act. According to it, if you get salary in arrears or advance in a financial year due to which your total income for the year increases, which in turn increases your taxable income, you can claim for relief under section 89. According to this section, arrears includes salary/family pension paid in arrears/advance (additional salary), certain part of gratuity, compensation received on termination of employment, and commuted pension. The rules apply to both government and private sector employees. You will have to fill up Form10E for claiming the relief.

thanks 4 reply sir but arrear of family pension comes in other sources head, and 10e can be made in case of only salary head. how to file the return in computax software?

Confusion is still, that family pension comes in other sources head then how can be claim relief u/s 89 which relate to only salary head????

SECTION 89 IS A RELIEF. IT CAN BE ADJUSTED WITH FAMILY PENSION AS MENTIONED IN THE SECTION ITSELF. THERE SHOULD BE NOT BE ANY CONFUSION IN THIS RESPECT.
