09 December 2012 Dear Sir,
We are going to form a partnership firm in Ghaziabad (U.P.). Whether we should draft partnership deed on the stamp paper of Rs. 750/- or we should draft it on Stamp paper of Rs. 950/-.
Please clarify.

09 December 2012 Hey Hi,

Stamp paper amount depends upon the initial capital contributions which you will be mentioning in partnership deed.

So can you let me know the amount of capital so that accordingly we can ascertain Stamp Paper amount.

Thanks//Vaibhav

10 December 2012 here amount of initial capital is not declared in partnership deed, becasue it would be invested by the partners later to the need of business. In such a case what would be stamp value - Rs. 750 or Rs. 950.

09 August 2024 The stamp duty for a partnership deed in India varies by state, and the value of the stamp paper required can depend on various factors, including the state regulations and the specifics of the partnership deed.

### **1. Stamp Duty for Partnership Deeds in Uttar Pradesh**

In Uttar Pradesh, the stamp duty on partnership deeds is governed by the Stamp Act of Uttar Pradesh. As of the latest guidelines:

- **Partnership Deed with Declaration of Capital:** If the initial capital is declared in the partnership deed, the stamp duty typically falls under a specific rate.
- **Partnership Deed without Declaration of Capital:** If the capital amount is not declared or if the partnership deed is general and does not specify the capital amount, the stamp duty may be different.

### **2. Stamp Duty Rates**

For the state of Uttar Pradesh, the relevant stamp duty rates are:

- **Partnership Deed with Capital Declaration:** The stamp duty on partnership deeds where the capital amount is specified is generally ₹750.
- **Partnership Deed without Capital Declaration:** If the capital is not declared in the partnership deed or if the deed is merely an agreement to form a partnership without specifying the capital amount, the applicable stamp duty could be ₹950, as this could be considered a higher rate for general or unspecified agreements.

### **3. Practical Steps**

1. **Check Latest Regulations:**
- Confirm the current stamp duty rates from the local Sub-Registrar or check the latest updates on the Uttar Pradesh government’s official website or legal resources.

2. **Consult a Legal Expert:**
- It is advisable to consult with a local lawyer or legal expert who can provide guidance based on the latest regulations and the specifics of your partnership deed.

### **Summary**

- **For Partnership Deed with Declared Capital:** The stamp duty is generally ₹750.
- **For Partnership Deed without Declared Capital:** It is generally advisable to use ₹950 stamp paper to avoid any issues.

### **Conclusion**

Based on the information provided, if the initial capital is not declared in the partnership deed, you should consider using stamp paper valued at ₹950. However, to ensure compliance with the latest regulations and to avoid any legal issues, it is strongly recommended to confirm the exact stamp duty requirement with a local legal expert or authority in Ghaziabad (U.P.).
