24 December 2014 Hello,

Can you please mention exact section written in the order U/S 245..

what i mean to enquire is ... Is it mentioned as SEc. 115 WR of the Income tax Act, 1961 ..???

04 August 2024 Section 115WR is not a standard section in the Income Tax Act of India. It’s possible that the section number might be a typographical error or a misinterpretation. However, I can help clarify what you might be dealing with if it's related to demand and refunds under different sections of the Income Tax Act.

### Understanding Section 245

**Section 245 of the Income Tax Act** deals with the adjustment of refunds against any outstanding tax demand. Here's a brief overview:

- **Section 245:** This section allows the Income Tax Department to adjust any tax refund due to a taxpayer against any outstanding demand or arrears. If you have a refund pending for a particular assessment year and also have a demand outstanding for another year, the department can adjust your refund against the outstanding demand.

### What to Do

1. **Review the Notice:**
- Carefully review the notice you received. It should specify the details of the outstanding demand and the refund being adjusted.

2. **Verify the Demand:**
- Cross-check the demand mentioned in the notice against your records. Ensure that the demand raised is accurate and relates to the appropriate assessment year. If there is a discrepancy, you may need to take corrective action.

3. **Section Reference:**
- Since Section 115WR does not appear to be a valid reference, ensure that the actual section mentioned in the notice is correctly understood. You might be referring to another section related to tax demands or refunds. Verify the exact section in the notice.

4. **Respond to the Notice:**
- If you believe that the demand is incorrect or if you have any objections, respond to the notice within the stipulated time frame. Provide any necessary documentation or clarification required by the Income Tax Department.

5. **Consult a Tax Professional:**
- If you find it difficult to understand the notice or need assistance in addressing it, consult with a chartered accountant or tax professional. They can provide guidance on how to handle the notice and resolve any issues related to demands or refunds.

### Conclusion

It’s crucial to ensure that you understand the exact section and its implications as mentioned in your notice. If the section reference is not clear, checking with the Income Tax Department or a professional is advisable. If you have any further details or need specific guidance on handling the notice, providing additional context might help in offering more targeted advice.
