For Assessment Year (AY) 2010-2011, the relevant format for Form 16 and Form 16A is the one that was applicable for the Financial Year (FY) 2009-10. The CBDT Notification No. 31/2009 introduced new formats for Form 16 and Form 16A, but these formats applied to financial years starting from FY 2009-10 (which is AY 2010-2011) onwards.
### **Forms Applicable for AY 2010-2011:**
- **Form 16:** As per CBDT Notification No. 31/2009, the new format was indeed applicable from FY 2009-10. Therefore, for AY 2010-2011, the updated format specified in this notification should be used.
- **Form 16A:** The new format introduced by the same notification also applies from FY 2009-10. So, for AY 2010-2011, this new format is applicable for TDS on non-salary payments.
### **Summary:** - **For AY 2010-2011 (FY 2009-10),** you should use the formats of Form 16 and Form 16A as specified in CBDT Notification No. 31/2009. - **No Retroactive Application:** The updated formats introduced by this notification apply starting from FY 2009-10, so for that period, the new formats are indeed the ones to use.
### **Key Aspects of the New Formats:** 1. **Form 16:** - **Part A:** Includes details of TDS deducted and deposited, including PANs of both deductor and deductee. - **Part B:** Contains details of salary, deductions, and tax calculations.
2. **Form 16A:** - For non-salary TDS, includes similar detailed information on TDS deducted and deposited.
