Long term Capital Gain where STT not Paid

16 July 2011 Hello sir,
If some one have gain from Long term capital where STT not paid, what tax rate?

And if LTGL (loss) where STT Not paid, is it set off with any gain? or C/f it to next year?

16 July 2011 tax payable @ 20% on gain.

If loss loss can be set off against other LTCG only except LTCG on which STT has been paid and can be carried forward to 8 years and can be set off against future LTCG.

1. In case STT not paid indexation allowed and tax rate is 20%.

LTCL can be set off against any LTCG only.

If there is no LTCG or insufficient LTCG, LTCL can be c/fd.


17 July 2011 U/s 112 it is taxable @ 20 % & the loss can be carried forward

20 July 2011 if it is taxable @20%, what if income from LTCG (STT NOT PAID) AMOUNT LESS THEN RS. 160000/-

20 July 2011 Basic exemption available.
