05 August 2011 One of my friend is doing job in dubai. Now he want to come back to India. He has saving of Rs.100 Lac. Please inform what will be the tax implications. Please also give relevant sections/case laws.

06 August 2011 The said income is taxable in that country as per their laws. As per Income Tax Act, If he stays outside India more than 182 days, he will qualify as Non-resident. Then, Income earned outside India is not taxable in India. Need to check the correct fact of the case.

06 August 2011 It depends on the status of the person or your friend if he is NRI then what ever funds he brings in India he has to open a NRI account then no tax implication. The income earned in India shall be taxed in India
