07 March 2015 The TDS on my Salary for Last 3years are
1)FY 2011-12 : Rs.2361
2)FY 2012-13 : Rs.4803
3)FY 2013-14 : Rs.3294

For 2013-14 I have already filed my ITR.

But for earlier FY 2011-12 & 2012-13 i have not filed my ITR, can file my ITR for the same with in March 2015 ?


08 March 2015 You can file return of FY 2012-13 i.e., AY 2013-14 within 31.03.2015 u/s 139(4) but a penalty of Rs 5000/- (Maximum) may be levied u/s 271F. Kevy of penalty u/s 271F is at the discretion of AO after giving you an opportunity of being heard.

Return of FY 2011-12 i.e., AY 2012-13 is time barred. Last date was 31.03.2014.

Only way to file return of AY 2012-13 is to invoke section 119(2)(b) i.e., application for condonation of delay. See below link for details:

I would like to thank you for your advice.



But i have a question in relation to this, that is if i will not file any ITR for FY 2011-12 & 2012-13 Can it attract to any fine or penalty.

or
Can i file ITR with penalty for 2012-13 and ignore the ITR for 2011-12.


09 March 2015 If you were not required to file return u/s 139(1) then no penalty.

09 March 2015 Sir,

Again i like to inform you due to some personal problems from July 2014 to Feb 2015 i am unemployed and at present my Salary in Small firm is only 15K per month and

The Total Salary for FY 14-15 is Rs.107130 TDS deducted for FY 14-15 is Rs.794/-

Hence i would like to ask you on the basis of above can i file a ITR for FY 2014-15 for refund of my TDS on Salary.

09 March 2015 First of all TDS on Salary should not have been deducted from you since your Income was well below Exemption limit of Rs 2.50 Lacs.

Now you need to file your Income Tax return to claim the refund of TDS deducted from you.
