18 August 2015 I've got a return acknowledgement from a client. Return for A.Y. 2012-13 was filed on 05 Nov 2014 but as per sec 139 this return could be filed only upto 31 Mar 14. I've checked this return on the profile of the client. Return is genuine and receipt also provided by CPC. I want to know how it was possible and whether we can file such returns?

18 August 2015 refer sec 119(2)b only cbdt can allow under speacial situations.

18 August 2015 But how that return was uploaded and receipt acknowledgement was issued by CPC. I've copy of that return.


18 August 2015 After due date only as per sec 119 (2)b when a request is made by assessee or in response to a notice by it dept that is allowed

23 August 2015 Check under which section the return was uploaded? Was it uploaded in response to notice under section u/s 142(1).

Section 119(2)(b) is applicable only for refund cases.

24 August 2015 Thanks for your reply but that's not the case. Actually the assessee is a small retail trader. He didn't get any notice under section 142 nor he applied to CBDT for condonation. He just wanted to avail credit facility from a bank that's why he approached to an advocate for return filing. I'm not able to understand how he was successful in uploading the return. Whether anyone has tried earlier to upload such return?
Current status of the return is "Out of jurisdiction of CPC return forwarded to AO for further action"

24 August 2015 I again request to to check the ITRV and see what is written in "Return filed under Section.....". Many person file such return showing section 142(1) even without receiving such notice. So please check and confirm.

Usually such return not involving tax refund can be submitted in paper form at the jurisdictional office.
